STANDARD 1-YEAR HARDWARE PRODUCT WARRANTY

The 1-year hardware product warranty replaces the previous 90-day product warranty on all RaceAmerica hardware products purchased after October 1, 2020.

To the original purchaser of this RaceAmerica product, RaceAmerica warrants the hardware to be in good working order for a period of one year from the date of purchase from RaceAmerica or an authorized RaceAmerica distributor. Should this product malfunction during the warranty period, RaceAmerica will, at its option, repair or replace it at no charge, provided the product has not been subjected to misuse, abuse, or alterations, modifications, and/or repairs not authorized by RaceAmerica. Consumable items such as antennas, cables, and batteries are not covered by the product warranty. Any product requiring Limited Warranty service during the warranty period should be returned to RaceAmerica with proof of purchase. If return of merchandise is by mail, the customer agrees to insure the product, prepay shipping charges, and ship the product to RaceAmerica, Inc., 105 Bonaventura Drive, San Jose, CA 95134.

ALL EXPRESSED AND IMPLIED WARRANTIES FOR THIS PRODUCT ARE LIMITED IN DURATION TO THE ABOVE ONE YEAR PERIOD FROM DATE OF PURCHASE. UNDER NO CIRCUMSTANCES WILL RACEAMERICA BE LIABLE TO THE USER FOR DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, SUCH PRODUCT. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.

DEPOSITS
Deposit payments received from customers accompanying an order for hardware or software typically represent 50% of the order total and are non-refundable if the order is cancelled.

CANCELLATION OF ORDER
Orders for hardware and software may be cancelled up to the date of shipment. Once the order is shipped, the RETURN OF EQUIPMENT policy applies. All deposits provided when the order was placed are non-refundable as stated above.

Extended Warranty Service with a coverage period of one year cannot be cancelled after the product has shipped and is not subject to a return credit.

Extended Warranty Service with a coverage period of two years or more can be cancelled for each full year of coverage after the first year. Cancellation request for subsequent coverage years must occur prior to the start of a coverage year which occur on the anniversary date of the start of the Extended Warranty Service. A 20% administrative fee applies to the amount on all cancelled services. Credit will be applied towards original payment method (Credit Card, Check, Bank Transfer, etc.)

LATE FEES
Final payment for all hardware and software sales orders is due immediately on the date the invoice is sent to the customer. Invoices are also included with each shipment of goods. Completed sales orders with an outstanding balance are held awaiting customer final payment and the invoice is due immediately upon notification to the customer the sales order is ready to ship. Payment is past due after 30 days from date of invoice. A past due late fee is added monthly to the outstanding balance equal to 1.2% of the outstanding amount.

RETURN OF EQUIPMENT
Standard hardware products defined as listed in the current price list may be returned up to 30 days after the date of invoice. All returns require an RMA number issued from RaceAmerica. RMA numbers can be obtained by calling RaceAmerica direct at (408) 988-6188. Credit is issued contingent upon the hardware being returned in like-new condition in the original packaging. Shipping charges, insurance, special handling fees, and expedited turnaround fees are customer responsibility and excluded from credit. A 30% restocking fee will be assessed on the credit total if a non-refundable deposit was not provided when the order as placed. Credit will be applied towards original payment method (Credit Card, Check, Bank Transfer, etc.).

Items marked as CUSTOM on the invoice are not returnable and are not subject to a credit.

Standard software products defined as listed in the current price list may be returned up to 30 days after the date of invoice if purchased with an associated hardware system. Software items are not returnable when purchased separately.

RENTAL EQUIPMENT
Hardware items shipped as ‘rental’ are billed at full list price at time of shipment. Upon return of the hardware items, a credit will be issued equal to the full list priced billed, minus the agreed upon rental price as indicated on the invoice, minus shipping and insurance charges, minus a Restoration Fee (if any) to restore the rental equipment to the pre-shipment condition. Restoration Fees do not include damage caused by shipping carriers covered by their normal shipping insurance.

SOFTWARE LICENSE
Purchase of a Software License issued to a customer enables the download of an assigned software package. Software Licenses are valid and functional for 90 days after issuance with up to 3 download attempts enabled. After 3 attempts within the 90 day period, a $25 administrative fee is charged for an additional 3 download attempts. Since software is continuously updated, after the 90 day period, there is no guarantee a Software License will be available for continued downloads. If a Software License was purchased within the past year and needs replacing, an update software package may be available for purchase at a reduced price. RaceAmerica is responsible for maintaining the Software License availability and the customer is responsible for maintaining a copy of the downloaded install file.

CUSTOM PRODUCTS
Standard products which are customized to meet a specific customer request or Custom products designed to meet a customer request are defined as CUSTOM. CUSTOM products are paid in advance and are non-cancelable and non-refundable. CUSTOM products are indicated on the invoice as ‘custom’.

TRANSFERS OF OWNERSHIP
Standard Product Warranty and Extended Warranty Service are not transferable. These warranties are tied to the original purchaser and the serial numbered hardware and related software purchased from RaceAmerica or a RaceAmerica authorized reseller.

PRIVACY STATEMENT
RaceAmerica does not share customer information without prior consent. Personal and private information provided by customers is obtained strictly for order processing purposes and is not shared internally uness prior consent is provided by customer.

COOKIES STATEMENT
RaceAmerica does not incorporate cookies or local storage in their website design. RaceAmerica's Online Store and Online Forum may incorporate cookies and/or local storage only to improve the user's overall experience and process orders.
